1. Parties and Acceptance of Terms
These Terms of Service (“Terms”) are a binding legal agreement between you and Eduardo A. (“we,” “us,” or “our”), the individual operator of Resume Autopsy (the “Service”), accessible at resumeautopsy.com.
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not access or use the Service.
2. Eligibility — Age Requirement
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you must not use this Service under any circumstances.
We do not knowingly provide services to or collect personal information from individuals under 18. If we become aware that a person under 18 has accessed the Service, we will take prompt steps to remove any associated data and restrict further access. Contact legal@resumeautopsy.com if you believe a minor has accessed the Service.
3. Description of the Service
Resume Autopsy is a web application that uses artificial intelligence (AI) to analyze resume text submitted by users and return a scored written analysis. The AI-generated output is provided for general informational and entertainment purposes only.
The analysis is generated by a large language model against your submitted text. It is not the assessment of a qualified career coach, licensed recruiter, human resources professional, or any other credentialed human expert. The score and written findings are generated automatically — no human reviews the output before it is delivered to you.
Do not make significant career, employment, or professional decisions based solely on feedback from this Service. The score and analysis produced by this Service may not be used as evidence of a person's qualifications or lack thereof in any employment, hiring, screening, or professional evaluation context.
Your use of the Service is also governed by our Privacy Policy, incorporated into these Terms by reference. By using the Service, you agree to the data practices described in that policy.
3a. AI-Generated Content Disclaimer
All analyses, scores, reports, rewrites, and recommendations provided by Resume Autopsy are generated by artificial intelligence and are for informational and educational purposes only. Resume Autopsy does not guarantee the accuracy, completeness, or reliability of any AI-generated content. Specifically:
- —Scores and ratings are algorithmic assessments, not professional evaluations.
- —Rewritten resumes may contain estimated metrics, inaccurate details, or content that does not reflect your actual experience.
- —Match scores and keyword analyses are estimates based on text comparison, not predictions of hiring outcomes.
- —ATS compatibility assessments are approximations and may not reflect the behavior of specific employer ATS systems.
You are solely responsible for reviewing, verifying, and editing any AI-generated content line by line before using it in job applications, on LinkedIn, or in any professional context. You must not submit any rewritten resume content to an employer or recruiter that you have not personally verified for accuracy. Resume Autopsy is not liable for any consequences arising from the use of AI-generated content, including but not limited to: missed job opportunities, inaccurate self-representation, or reliance on estimated metrics.
3b. Not Professional Advice
Resume Autopsy is not a career counseling service, employment agency, or recruiting firm. The analysis and recommendations provided do not constitute professional career advice. For personalized career guidance, consult a certified career counselor or professional resume writer.
3c. No Guarantee of Results
Resume Autopsy does not guarantee that using our analysis or rewrites will result in job interviews, job offers, or any specific employment outcome. Hiring decisions are made by employers based on numerous factors beyond resume content.
3d. Recruiter and Employer Use
If you use Resume Autopsy in a recruiting, hiring, or candidate-evaluation capacity, you agree to the following:
- —Resume Autopsy scores, verdicts, and rankings are not hiring assessments and must never be the sole or primary basis for any employment decision, including hiring, promotion, or rejection of a candidate.
- —All employment decisions must include human review by a qualified hiring manager and must be based on multiple factors beyond any score produced by this Service.
- —You are solely responsible for ensuring that your use of this Service complies with all applicable employment laws, including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and all equivalent federal, state, and local laws.
- —You must not use this Service to screen, rank, or evaluate candidates in a manner that discriminates on the basis of any protected characteristic, including but not limited to race, color, religion, sex, national origin, age, disability, or genetic information.
- —You are responsible for ensuring that candidates whose resumes you upload have provided the necessary consent or that you have a lawful basis to process their personal data under applicable law.
- —You are solely responsible for compliance with all applicable AI-in-hiring disclosure and audit requirements in your jurisdiction, including but not limited to New York City Local Law 144, Colorado SB 24-205, and any equivalent state or local laws governing the use of automated employment decision tools.
Resume Autopsy disclaims all liability for employment decisions made by recruiters or employers using this Service. The operator of Resume Autopsy is not an employer, staffing agency, or employment screening service as defined under applicable law.
4. Your Responsibilities
You are solely responsible for all content you submit to the Service. By submitting content, you represent and warrant that:
- —You are submitting only your own resume, or content you are fully and lawfully authorized to share.
- —You are not submitting resumes, personal information, or any content belonging to another person without their explicit, prior, informed consent.
- —The content you submit does not violate any applicable law or regulation.
- —You will not submit harmful, illegal, abusive, threatening, defamatory, obscene, or fraudulent content.
- —You will not abuse, overload, or degrade the performance or availability of the Service.
- —You will not attempt to reverse-engineer, decompile, disassemble, or circumvent any technical protection or security measure of the Service.
- —You will not attempt to manipulate, override, or otherwise interfere with the AI system through resume content, embedded instructions, or any other mechanism.
- —You will not use automated scripts, bots, scrapers, crawlers, or other non-human access methods to interact with the Service.
- —You will not use the Service in any way that violates applicable local, state, national, or international law or regulation.
Violation of any of the above may result in immediate suspension or permanent termination of your access without prior notice.
5. Waitlist and Paid Features
If you submit your email address for a waitlist or notification list, you consent to receiving: (1) a confirmation of your registration; (2) notifications when the relevant feature or tier becomes available; and (3) occasional product updates and announcements related to the Service.
Every marketing or promotional email sent to you will include a clearly visible unsubscribe link. Clicking that link will remove you from all future marketing communications within 10 business days. You may also request removal at any time by contacting privacy@resumeautopsy.com.
Paid features are subject to the payment terms and tier limits presented at sign-up or purchase. We reserve the right to modify pricing, features, or access terms for paid tiers with at least 14 days' prior written notice to affected subscribers by email. Changes to free-tier terms are governed by Section 13 below.
Refund policy: All purchases are final. Because the Service delivers AI-generated analysis at the time of processing, completed sessions are non-refundable. No refunds will be issued for sessions where results were successfully returned, regardless of whether you agree with or act on the analysis.
Technical failure exception: If a session fails to return any results due to a verified technical error on our end, you are entitled to a full refund of the amount paid for that session. To request a refund under this exception, contact legal@resumeautopsy.com within 7 days with your account details and a description of the issue. We will review and respond within 5 business days.
6. Service Provided “As-Is”
The Service is provided without guarantees of any kind. We do not guarantee that the feedback will be accurate, helpful, complete, or appropriate for your situation. The Service may be unavailable, slow, interrupted, or produce incorrect or unexpected results at any time and without notice. We reserve the right to modify, suspend, or discontinue the Service at any time.
7. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Resume Autopsy and its operator make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. No oral or written information provided by or through the Service creates any warranty not expressly stated in these Terms.
Some jurisdictions do not permit the exclusion of certain implied warranties. To the extent such exclusions are not permitted in your jurisdiction, they apply to the fullest extent allowed by applicable law.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Resume Autopsy and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of employment, loss of income, loss of data, loss of business opportunity, or emotional distress — arising from your use of or inability to use the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the total aggregate liability of Resume Autopsy and its operator to you for all claims arising from or related to these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you paid to Resume Autopsy in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) ten dollars (US $10.00).
In jurisdictions that do not permit the exclusion or limitation of certain categories of damages, liability is limited to the fullest extent permitted by applicable law in that jurisdiction.
9. Indemnification
You agree to defend, indemnify, and hold harmless the operator of Resume Autopsy and their respective agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- —your use of the Service in violation of these Terms;
- —content you submit through the Service;
- —your violation of any applicable law or regulation;
- —your infringement or misappropriation of any third party’s intellectual property or other rights; or
- —any claim by a third party arising from your submission of content relating to that third party without their consent.
We reserve the right, at your expense, to assume exclusive control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
This indemnification obligation does not apply to claims arising in whole or in part from Resume Autopsy's own negligence, willful misconduct, or material breach of these Terms.
10. Intellectual Property
You retain full ownership of the resume content you submit. By submitting content, you grant us a limited, non-exclusive, royalty-free, temporary license to process that content solely for the purpose of generating and returning an analysis to you during your active request. This license terminates immediately upon completion of your request. We do not store, retain, license, sell, or use your resume content for any other purpose, including training AI models. You also retain full ownership of any analysis results, scores, reports, rankings, and rewrites returned to you by the Service. You may use these results internally for personal or business purposes. You may not resell or publicly republish AI-generated output as original work.
We retain full ownership of the Resume Autopsy name, brand, design, software, AI prompts, scoring methodology, output format, and all other materials comprising the Service. Nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property beyond the limited right to use the Service as described herein.
11. Suspension or Termination of Access
We reserve the right to suspend or permanently restrict access to the Service for any user or IP address that we reasonably believe is abusing the Service, violating these Terms, attempting to circumvent security measures, or causing harm to the Service or other users. Such action may be taken at our sole discretion and without prior notice.
If you believe your access was suspended in error, you may contact us at legal@resumeautopsy.com to request review. We are not obligated to restore access, but we will review good-faith requests within a reasonable time.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12.2 Informal Resolution
Before initiating any formal dispute process, you agree to first contact us at legal@resumeautopsy.com and attempt to resolve the dispute informally. We will make reasonable good-faith efforts to resolve the matter within 30 days of receiving written notice describing your dispute in sufficient detail.
12.3 Binding Individual Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service — including questions about the validity, enforceability, or scope of this arbitration agreement — shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except as provided in Sections 12.4 and 12.5.
Arbitration shall be conducted in Hillsborough County, Florida, or, at your election, by video or telephone conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator has authority to award any remedy available at law or in equity, subject to the limitations in Section 8.
12.4 Class Action Waiver
You and Resume Autopsy agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. If this class action waiver is found to be unenforceable as to a particular claim or request for relief, then only that claim or request for relief shall proceed in court and shall be severed from any arbitration.
12.5 Exceptions to Arbitration
Either party may: (1) bring an individual claim in small claims court if the claim qualifies and remains in small claims court jurisdiction; and (2) seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, including for alleged intellectual property violations. Seeking such interim relief does not waive the right to arbitration for the underlying merits.
12.6 Arbitration Costs
Arbitration fees will be allocated per the AAA Consumer Arbitration Rules. For claims under $10,000 USD filed by you, Resume Autopsy will pay all AAA filing and arbitrator fees unless the arbitrator determines your claim is frivolous or brought in bad faith.
13. Changes to These Terms
We may update these Terms at any time. The “Last updated” date at the top reflects the most recent revision. For non-material changes, continued use of the Service after updated Terms are posted constitutes acceptance of the revised Terms.
For material changes — including any changes to the arbitration clause, class action waiver, limitation of liability, or any provision that significantly alters your rights — we will make reasonable efforts to notify waitlist subscribers by email at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the operator of Resume Autopsy regarding your use of the Service. They supersede all prior agreements, understandings, and representations — written or oral — between you and us regarding the subject matter herein.
